1.2. Digital Products: Refers to the downloadable jersey design files, graphics, templates, and any related digital materials purchased from the Site.
1.3. User/Customer: Refers to any person who accesses or purchases Digital Products from the Site.
1.4. Acceptance: Your placement of an order, downloading of any file, or use of the Site constitutes your acceptance of these Terms.
2. Digital Product License and Intellectual Property
2.1. Ownership of Content
You acknowledge and agree that jerseydesignes.com retains all ownership, copyright, and intellectual property rights in the Digital Products, including all jersey designs and underlying code. You are purchasing a non-exclusive license to use the design, not ownership of the design itself.
2.2. Standard License: Permitted Use
Upon full payment, you are granted a single-user, non-transferable, limited license to use the Digital Products for the sole purpose of:
- Final Physical Use: Creating a single, final physical product (e.g., one jersey, t-shirt, or physical print) for personal use only.
- Minor Modification: Making necessary minor edits to the design (e.g., changing text, colors, numbers) to fit your final physical product.
2.3. Restrictions on Use (Prohibited Activities)
You expressly agree that you will NOT:
- Resell/Distribute Files: Resell, redistribute, sublicense, share, transfer, or give away the Digital Product files in any digital format, either modified or in their original state.
- Mass Production/Commercial Use: Use the design for mass production, print-on-demand services (like Printful, Redbubble, Zazzle, etc.), or any commercial activity unless a separate, explicit Commercial License is purchased from us.
- Claim Authorship: Claim the Digital Product as your own original work, even if you have modified it.
- Create Derivative Digital Products for Sale: Use the design to create other digital products (e.g., mockups, templates, vectors) for sale or distribution.
Violation of these licensing terms will result in immediate termination of your license without refund and may lead to legal action.
3. Pricing, Payments, and Refunds
3.1. Pricing and Payment: All prices are listed in INR (Indian Rupees). We reserve the right to refuse or cancel any order placed for a product listed at an incorrect price.
3.2. Refund Policy: Due to the instant, non-returnable nature of digital goods, all sales are final once the download link has been accessed or the file has been downloaded. We do not offer refunds, exchanges, or credits unless the product is fundamentally flawed or technically inaccessible.
4. Disclaimers and Limitation of Liability
4.1. “As Is” Basis: The Digital Products are provided “as is” and “as available” without warranties of any kind. We are not responsible if the files are incompatible with your specific software version or lack of technical expertise.
4.2. Limitation of Liability: To the maximum extent permitted by law, jerseydesignes.com shall not be liable for any direct, indirect, incidental, special, or consequential damages (including loss of profits or data) arising out of your use or inability to use the Digital Products. In all cases, our total liability will not exceed the amount you paid for the specific Digital Product at issue.
5. General Provisions and Contact
5.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of Uttar Pradesh.
5.2. Right to Refuse: We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly in cases where we suspect a violation of these Terms.
